West Virginia has no state OSHA plan, so employers fall under the federal rule (29 CFR 1910.151(b)): there is no fixed ratio, but where no medical facility is in near proximity at least one person must be adequately trained in first aid and reachable within minutes.
West Virginia child care center licensing (Legislative Rule Title 78 Series 1, §78-1-8.6.f.1) requires staff to hold current age-appropriate CPR certification plus current first aid training within six months (180 days) of hire, with at least one qualified staff member present whenever children are on the premises.
West Virginia's Good Samaritan law (W. Va. Code § 55-7-15) protects anyone who in good faith renders emergency care at the scene of an accident or crime from civil liability, covering both laypersons and licensed medical professionals; there is no legal duty to rescue.
Registered nurses in West Virginia renew through the West Virginia Board of Registered Nurses, which requires 12 continuing-education contact hours per 2-year cycle from a Board-approved provider (verified via CE Broker); basic life support is generally an employer or hospital requirement, though an accredited resuscitation course can count toward the contact hours.
In West Virginia residential settings — assisted living residences, nursing homes and home-care services — certified nurse aides receive CPR as part of the state-approved 120-hour nurse aide program and long-term-care employers require it; a recognized, up-to-date CPR and first-aid certificate meets this expectation and is renewed periodically.
In West Virginia, foster parents must become CPR- and first-aid-certified before a foster child is placed with them and must keep those certifications current, obtained from a recognized provider.
Online CPR and first aid training is recognized in West Virginia — there is no ban on online training for workplace first-aiders, online theory is accepted (a hands-on component is recommended for CPR), and certification is valid for 3 years.
